The Constitution of Sancratosia (Lingua Franca Nova: Constitui de la Prinsia de Sancratosia) was adopted on 2 December 2021 (2021-12-02), on the day following the independence of the Principality. It was subsequently published in the first edition of the Journal of Sancratosia on 17 December 2021 (2021-12-17).[1] It is the fundamental law of the Principality of Sancratosia.

Inspiration

The Constitution follows a similar structure to that of the Constitution of Monaco.

Provisions

The Constitution of Sancratosia includes the Preamble and 96 articles. The articles are separated in 12 titles.

Preamble

The preamble to the Constitution establish its authorship to that of the Sovereign Princess.

We, Cloe, by the popular and national will, Sovereign Princess of Sancratosia;
We have determined to give a Constitution, which, by Our sovereign will, is from this moment considered as the fundamental law of the State and can only be modified in the terms that We have determined.

Title I

The first title, The Principality and the public powers, includes articles 1 to 9 and outlines the general fundamental principles of the Principality. It notably establishes the separation of powers, defines the flags and the coat of arms as well as the official and recognized languages.

Title II

The second title, The Princess and the devolution of the Crown, includes articles 10 to 16 and concerns mostly the relation between the State and the Sovereign Family. It specifies the powers which are not devolved to other functioning organs of the Principality.

Title III

The third title, The freedoms and fundamental rights, includes articles 17 to 32 and is the Sancratosian equivalent to a bill of rights. It enshrines certain fundamental rights and freedoms to Sancratosians such as the individual security, the inviolability of the home, the right to private and familial life, the liberty of cults, the right to free instruction and the freedom of association, among many others.

Title IV

The fourth title, The public domain and the public finances, includes articles 33 to 42. This title explains the conditions in which a private good becomes a public good as well as outlining some conditions for the budget which notably includes a provision to provide for the expenses of the Sovereign Family in priority on the general revenues of the State.

Title V

The fifth title, The Government, includes articles 43 to 51 and concerns the Government Council. It establishes the position of Minister of State as well as the powers given to the Government Council.

Title VI

The sixth title, The State Council, includes article 52. It establishes the State Council.

Title VII

The seventh title, The National Council, includes articles 53 to 74 and concerns the National Council. It establishes the National Council as well as the provisions for the election of its members and their eligibility, its meetings, the legislative process and its dissolution.

Title VIII

The eight title, The Crown Council, includes articles 75 to 77. It establishes the Crown Council.

Title IX

The ninth title, The Municipality, includes articles 78 to 87 and concerns the Municipality. It establishes its administrative body, the Municipal Council and the provisions for the election of its members, its meetings and its dissolution.

Title X

The tenth title, The Justice, includes articles 88 to 92 and concerns the administration of justice. It establishes the Supreme Court, the nomination of its members and its competence in the matters brought before it.

Title XI

The eleventh title, Revision of the Constitution, includes articles 93 to 95 and provides a process for the revision of the Constitution.

Title XII

The twelfth title, Final dispositions, include article 96 and concerns the entering in force of the Constitution. It is the shortest title.
