Purpose Declare the Constitution of Shorewell inoperative and establish a provisional government.

The Pesakh Declaration is an instrument of government issued by Sultan Bilal I of Shorewell through which much of the constitution was declared inoperative alongside large-scale reforms to the structure of government, goals, and defining features of the state. The declaration came after a prolonged period of inactivity following the collapse of a majority government due to the expiration of the term limits of the chambers of deputies and the office of grand vizier. It is termed the "Pesakh Declaration" for having eventually been ratified on the weekend of Passover in the Hebrew Calendar.

The full text of the Instrument of Government as drafted by Sultan Bilal Irfan on 3 April 2020, reformed and executed in a second draft on 28 March 2021, and accepted as legal on the evening of is as follows:

Noting the rights engrained upon the Sultan and the General Assembly thereof to establish peace, justice, security, and sustainability throughout the lands, the inadequate usage of such responsibilities, and the principles acknowledging the rights of sovereign states.
Whereas the Treaty of Madaz-a-Maloom provides that as from the 20th day of July, 2017, there shall be set up various independent states, and that the Princely States Act shall, with such omission, additions, adaptations and modifications as the monarch of Shorewell may by order specify, be applicable to the Sultanate of Shorewell.
And whereas the Princely States Act, as so adapted by the monarch of Shorewell, provides that a protected state of Shorewell may accede to the Sultanate of Shorewell by an Instrument of Accession executed by the Ruler thereof.
Now, therefore, I Bilal Irfan, Sultan of Shorewell, in the exercise of my sovereignty in and over my said State do hereby execute this Instrument of Government:
Draft I

  1. The General Assembly of Shorewell is to be dissolved with all legislators being officially dismissed and all rights, responsibilities, and privileges attached thereof are to be dismantled.
  2. All government ministries and the workers therein are to be abolished and all rights, responsibilities, and privileges attached thereof are to be dismantled.
  3. The Supreme Court and all judiciary functions of the Sultanate shall be abolished with all the rights, responsibilities, and privileges attached to its members to be dismantled.
  4. All princely states of Shorewell shall be given a fully autonomous status within the country and all ties between the Sultanic government and such states shall be severed in perpetuity. All executive, judicial, and legislative powers shall reside within the anointed government of such states and the Sultanic government shall no longer have the authority to formulate laws for such states or impose its will.
    • Note: A formal recognition or grant of independence to such states shall be withheld.
  5. The rulers of the constituent states of Shorewell will be officially deposed and their titles, lands, and dynasties will have their recognition and status (ceremonial or otherwise) revoked. The states shall be left to operate and decide on their own futures (short of independence).
  6. The Constitution of Shorewell shall be deemed inoperative by the Sultan’s Decree by citing sections of Article II which explicitly states “The Monarch is sovereign over the Shorewell - all sovereignty and political power is derived from and is ultimately held by the Monarch, although it is acknowledged that the Monarch holds his position from the will of the people; All executive, legislative, and judicial power is derived from and carried out in the name of the Monarch.” without violating Article IX “This constitution may be altered or changed with the approval of the majority of the General Assembly”.
    • In lieu of this, the Sultan renounces all executive, legislative, judicial powers, roles, and responsibilities alongside ceremonial duties attached to the bareholder of the throne.
    • The House of Sheikh is derecognized as the Sultanic House, and all members of the Imperial Family are subject to no ceremonial privilege or duty in respect to their title.
    • The United States of America shall presume full civilian and military jurisdiction over the former constituent states not including the Crownlands.It’s authorities and laws will be recognized to avoid anarchy (without officially recognizing the cessation of land).
    • The Crownlands shall be administered by a joint Shoro-American concordance, with US Civil Law applying to the region in such respects as agreed to by the consent of the majority of the population and the Sultan.
    • This Constitution may only be declared operative and fully functional by the unanimous approval of all American citizens residing in the Crownlands at this time. If for any reason any of those citizens were to lose their said citizenship or no longer be able to participate in a vote to reverse this decree, it shall become a permanent feature.
      • Said citizens will be given the authority to, with unanimous support, create the functionaries and vestiges for a new government including the appointment of a Sultan.

This Instrument of Government shall go into effect at the midnight hour of April 5th, Eastern Standard Time.

On March 28th, 2021, 12:00 PM EST at the Noon Hour, the Sultan officially tabled this draft of reformation in lieu of a new one designed to address a new state of order.

Failure to ratify the decree compounded with the fallout from the COVID-19 pandemic led to the establishment of a comprehensive framework of government a year later, stipulated in the final and binding text as follows:

Draft II

  1. The Constitution of Shorewell shall be deemed inoperative by the Sultan’s Decree by citing sections of Article II Section 1 which explicitly states “The Monarch is sovereign over the Shorewell - all sovereignty and political power is derived from and is ultimately held by the Monarch, although it is acknowledged that the Monarch holds his position from the will of the people; All executive, legislative, and judicial power is derived from and carried out in the name of the Monarch.” without violating Article IX “This constitution may be altered or changed with the approval of the majority of the General Assembly”.
    • The aforementioned clauses in Article II Section 1. “The Monarch is sovereign over the Shorewell - all sovereignty and political power is derived from and is ultimately held by the Monarch, although it is acknowledged that the Monarch holds his position from the will of the people; All executive, legislative, and judicial power is derived from and carried out in the name of the Monarch.” shall remain operative, legal, and the defining parameters for all future edicts, decrees, legislation, laws, acts, or ordinances carried out by the Sultan.
    • The General Assembly of Shorewell is to be dissolved with all legislators being officially dismissed and all rights, responsibilities, and privileges attached thereof are to be dismantled.
      • Failure to conclude an election following the end of term limits for the Prime Ministerial (Grand Vizier) or Chamber of Deputies has led to the de jure collapse of a functioning majority government.
    • All government ministries and the workers therein are to be abolished and all rights, responsibilities, and privileges attached thereof are to be dismantled.
    • The Supreme Court and all judiciary functions of the Sultanate shall be abolished with all the rights, responsibilities, and privileges attached to its members to be dismantled.
    • In lieu of this, the Sultan resumes all executive, legislative, judicial powers, roles, and responsibilities alongside ceremonial duties attached to the bareholder of the throne.
    • The House of Sheikh is reaffirmed as the Sultanic House.
      • The formal suspension of all titles, privileges, and duties possessed by the members of the royal family are rescinded indefinitely.
      • The House of Sheikh will indefinitely constitute only the Sultan himself, with the inclusion of other members contingent upon future ordinances.
  2. Having noted the evolving geopolitical landscape that has transpired in the past few years:
    • The United States of America shall presume full civilian and military jurisdiction over the constituent states of Shorewell not including the Crownlands. It’s authorities and laws will be de facto recognized in a bid to avoid anarchy (without officially recognizing the cessation of land or transfer of authority).
      • The rulers of the constituent states of Shorewell will be officially deposed and their titles, lands, and dynasties will have their recognition and status (ceremonial or otherwise) revoked.
        • The states shall be left to operate and decide on their own futures (short of independence).
        • Governments may be formed in the constituent states with the approval of residents residing in the respective states at this time OR by the expressed consent of the Sultan.
          • “Approval of residents” may constitute a majority, a consensus, a group, party, individual, or body that has received recognition of its provisional authority by the Sultan.
          • Said residents will be given the authority to, with Sultanic recognition, create the functionaries and vestiges for a new government.
        • In the interim, the Sultan officially derecognizes and disbands any other vestige of local government or administrative authority in the constituent states.
    • The Crownlands shall be administered by a joint Shoro-American concordance, with US Civil Law applying to the region in such respects as agreed to by the consent of the Sultan.
    • This Constitution may be declared operative and fully functional or amended thereafter by the expressed consent of the Sultan.
    • All princely states of Shorewell shall be given a fully autonomous status within the country and several ties between the Sultanic government and such states shall be severed. All executive, judicial, and legislative powers shall be transferred indefinitely to the anointed government of such states and the Sultanic government shall abstain from exercising any perceived obligation to formulate laws for such states or impose its will through administrative measures.
      • A formal recognition or grant of independence to such states shall be withheld.
  3. The terms “State of Shorewell”, “Sultanate of Shorewell”, and “Shorewell” will be deemed as holding equal status in defining the status of this nation.
  4. Shorewell declares itself a community based on shared principles, values, ethics, and allegiance to the advancement of interests of its constituents.
  5. Shorewell commits itself to actively promoting an environment of educational rigor and research, including basing itself as a group dedicated to pursuit of academic advancements.
  6. Noting the intertwined history of people of faith and Shorewell:
    • Islam is officially recognized as a religion by the state.
      • Shorewell will strive to establish a body of ulema to issue advisory opinions on matters relating to the Islamic faith.
      • The legal authority of the four traditional schools of jurisprudence are recognized, with practitioners of those being considered Muslim. These are:
        • Hanafi
        • Hanbali
        • Maliki
        • Shafi
    • Freedom of religion is guaranteed as an inalienable right. Religious communities have the right to assemble and have recognized bodies representing them to the state.
      • No distinction or idenftication will be made in the civil side for Muslim and non-Muslim residents, save for negotiated agreements in regards to private religious laws relating to inheritance, property, or other family matters which bodies would have to negotiate with the government to have executed and guaranteed.
    • Shorewell commits itself to the full recognition of the legal and moral rights endowed upon its citizens, residents, and all peoples irrespective of race, religion, ethnicity, nationality, class, or creed as deemed by the Universal Declaration of Human Rights.
  7. The demonym of the citizens and nationals of Shorewell will be Shorewellese.
    • Citizenship can be obtained through a process of application, a pledge of allegiance to the nation, and approval by the government.
    • Shorewellese identity strives to be built on the principle of shared values, while attempting to foster a national consciousness.
      • Keenly aware that languages including Jelmazmo and Jaykoejian are only prevalent in the State, as well as the significant Muslim population; it still strives to build its representation based off ethnonationalism through community cultivation rather than primarily ethnolinguisic or ethnoreligious identity.
  8. Shorewell recognizes the following languages as official and working in the State, and strives to ensure all legal documents, signs, and media provides equitable distribution of them:
    • English
    • Arabic
      • Modern Standard Arabic
      • Symbolic and cultural recognition of Classical Arabic
    • Hindustani
      • Modern Standard Urdu
    • Hebrew
  9. Due to a lack of stable economic growth, regulative measures, and the dependence on large-scale imports, the Shorewellese Dinar will be taken out of circulation for the time being. Shorewell will retain its legal status as the official currency of the state, but will begin using and sanctioning trade in the United States Dollar.
  10. Shorewell will seek to pivot its foreign relations in regards to promoting mutual recognition, safety, security, and strategic cooperation between other states.
    • It shall strive for the recognition of the role of Shorewellese govenment to act as the custodians of mosques and Muslim (or other-agreed upon) holy sites in other states through a waqf or a recognized linkage under the Sultanic authority.
      • Promotion of cultural ties, linguistic exchange, and other bilateral exercises will be aimed to be acheived.
      • Countries will respect the present special role of the Sultanate of Shorewell in Muslim Holy shrines in several areas. When negotiations on the permanent status of relations will take place, states will give high priority to the Shorewellese stipulated and envisioned role in these shrines.
    • It commits itself to an emphasis of the following protocols in regards to the establishment of ties with other states:
      • Recognition of the United Nations Charter as well as the working authority of its six principal organs:
        • The General Assembly
        • The Security Council
        • The Economic and Social Council
        • The Trusteeship Council
        • The International Court of Justice
        • The UN Secretariat
      • An opposition to the ongoing human rights violations against the Uighur and Rohingya populations, as well as other groups around the world as designated by the UNHCR and Amnesty International.
      • Endorsement of the Arab Peace Initiative on the lines of:
        • Full Israeli withdrawal from all the Arab territories occupied since June 1967.
        • Implementation of United Nations Security Council resolutions 242 and 338.
        • The establishment of an independent Palestinian state, with East Jerusalem as its capital.
        • A just solution to the Palestinian Refugee problem, to be agreed upon in accordance with section 11 of UN General Assembly Resolution 194.
        • The normalization of relations in the context of a comprehensive peace.
      • Explicit Recognition of East Jerusalem as the capital of the State of Palestine.
      • Condemnation of Israeli settlements in the West Bank as a blatant violation of international law under the Geneva Conventions.
      • Commitment to a plebiscite in determining the final status of the undivided State of Jammu and Kashmir.
      • Opposition to religious-enticed violence and apprehension regarding the growth of Wahabbist-ideals, Ultra-Religious Zionism, Hindutva nationalism, and White supremacism.
  11. Shorewell will pledge to build its community fostered on a vested interest in the pursuit of advancements in the sciences, the arts, global politics, religion, philosophy, mathematics, and conflict resolution. It shall aim to amass collections of knowledge and information-gathering on topics of interest headed by media and library outlets that will provide access to books, publications, and news.
  12. The establishment of a provisional governing authority composed of a provisional legislative Council consisting of an undefined number of members as appointed by the Sultan.
    • The Provisional Governing Authority will be tasked with maintaining the political, social, and economic status quo of the country until a transition to the full implementation of the Constitution, the adoption of an alternate piece of defined legislation, or the establishment of a permanent successive government.
    • The provisional governing authority will be considered the Provisional Government of Shorewell.

This Instrument of Government shall go into effect at 6:10 PM EST on the 28th of March, 2021 (Shaban 14th, 1442 AH).
