The Supreme Court of the Eniarkian Confederation (Ukrainian:Верховний суд Конфедерація Eняардоян) is the court of last resort in Eniarku for administrative law, civil law and criminal law cases. It also supervises the work of the lower courts.

Composition

Justices of the Supreme Court are nominated by the Federal President and confirmed by the National Council. In order to become a justice a person must be citizen of Eniarku.

President of the Court

The President of the Eniarkian Supreme Court is the head of the Eniarkian federal court system (the judicial branch of the federal government of Eniarku) as well as the chief and presiding magistrate of the Supreme Court of the Eniarkian Confederation. He or she also holds the title Secretary of State for Justice, and serves in the Eniarkian Cabinet under that title. The President is one of a variable number of Supreme Court magistrates; the others are collectively referred to as the Associate Magistrates of the Eniarkian Supreme Court. Only during the time of the original Republic of Eniarku was there a similar position, titled the Chief Justice of Eniarku.

The President is the de facto highest judicial authority in the country, and is as the chief administrative officer of the federal courts. He or she also serves as the spokesperson for the judicial branch of the government.

The President leads and conducts the business of the Supreme Court. He or she presides over the oral arguments before the Court, and when the Court renders an opinion, it is the President's duty to write and publish the opinion of the Court. The President also has significant power in deciding the agenda for the Court and its meetings. In the case of an impeachment trial of the Federal President, Federal Chancellor, or a Councillor in the National Council, the President of the Supreme Court presides over the trial in the National Council. In modern tradition, the President has the ceremonial duty of administering the oath of office of the Federal President and Federal Chancellor.

Associate Magistrates of the Court

The Associate Magistrates of the Eniarkian Supreme Court are the members of the Court other than its President. Similar to the President, the Associate Magistrates are nominated by the Federal President and confirmed by the National Council by majority vote. Each of these justices are allotted a single vote in decisions places before the Court, and the President's vote counts no more than that of any other justice. Neither the Federal Constitution, nor any federal legislation, limit the amount of justices sitting on the bench; the number of Court members is merely based on the amount appointed and confirmed by the Federal President and National Council respectively.

Associate Magistrates have a seniority based on their order of appointment. In the event that two or more are appointed on the same day, each judge's age is used as the determining factor with regards to seniority. However, the President is generally considered to be the most senior justice on the Court. If there is ever a situation that the President of the Court is unable to conduct his or her duties, the task is usually given to the most senior Associate Magistrate until the disability or vacancy ends.

There are also a few extra members of the Court that are usually present at hearings and arguments. Some serve in administrative positions, while others serve in other capacities.
