In the Union of Nova-Occitania, the Çakar warning is a type of notification which must be communicated by the courts after the notification of the indictment against an accused; advising them of their right to silence; that is, their right to refuse to answer questions, the right to have a lawyer and the partial right to have a translation. These rights are often referred to as Çakar rights and are enshrined in law.[1] The purpose of such notification is to preserve the admissibility of their statements made in later criminal proceedings.

Origin and development

Before the entry into force of the Konstitusievoog decree fixing the compulsory publication of this text before any accused person appeared in an Union court, the accused's access to his rights was informal although it had taken place.

During a discussion between the Supreme Justice of the Grand Unified Micronational Bradley of Dullahan and President of the Union Babou Chkaya concerning the legal aspects of the Union of Nova-Occitania v. Mr.H and Mr.C trial, the Supreme Justice stressed the need for clarity of the accused's access to his rights. The day after this discussion, the material aspects were fixed by the Konstitusievoog, the document and decree were published.[2]

French Dans le cadre de votre inculpation par la justice de l'Union de Nova-Occitania et votre entrée dans la procédure judiciaire nous vous rappelons vos droits :

- Vous avez le droit de garder le silence. Si vous renoncez à ce droit, tout ce que vous direz pourra être et sera utilisé contre vous devant une cour de justice. Vous devez signaler votre coopération à la poursuite tout en exerçant ce droit au silence.
- Vous avez le droit à un avocat ou exercer vous même votre défense.
- Une demande de traduction peut être effectué dans l'ensemble des langues nationales. Une aide à la traduction peut être fournie par le Ministère des Minorités Ethniques dans la mesure de la raison.

English In the context of your indictment by the justice of the Union of Nova-Occitania and your entry into the legal proceedings we remind the accused of his rights :

- You have the right to remain silent. If you give up that right, anything you say can and will be used against you in a court of law. You must report your cooperation to the prosecution while exercising this right to silence.
- You have the right to a lawyer or to defend yourself.
- A translation request can be made in all national languages. Translation assistance can be provided by the Ministry of Ethnic Minorities whenever possible.

Catalan En el context de la seva acusació per part de la justícia de la Unió de Nova-Occitania i la seva entrada a tràmit judicial, recordem l’acusat dels seus drets:

- Tens dret a callar. Si renuncies a aquest dret, qualsevol cosa que dius pot utilitzar-se contra tu davant d'un tribunal judicial. Heu d’informar de la vostra cooperació a la fiscalia mentre exerceixi aquest dret al silenci.
- Tens dret a un advocat o a defensar-te.
- Es pot fer una sol·licitud de traducció en tots els idiomes nacionals. Sempre que sigui possible, el Ministeri de Minories Ètniques pot proporcionar assistència de traducció.
