The Captain-General of Lovinia (Filipino: Kapitan-Heneral ng Lovinia) is the Captaincy of Lovinia's Head of State and Head of Government. It is also the head of the Executive Department of Lovinia and the Commander-in-Chief of the Lovinian Peacekeeping Guards.

The current Captain-General is John Nobleza, after being elected on December 1, 2022, with an absolute majority of the Lovinian population. He took his oath of office on January 1, 2023.

Title

The Captain-General of Lovinia is the formal title of the Head of State and Government. The word was taken from the "Captaincy-General of the Philippines," which was the Philippines' official name during the Spanish colonial period.

The President is addressed as "Your Excellency" or "His/Her Excellency."

History

The status of Lovinia's Head of State and Government has changed over time.

During the Kingdom of Lovinia, the Monarch was the Head of State, and the Prime Minister was the Head of Government. The President of the Lovinian Federal Republic is chosen directly. During the FPDRL period, the President is the Head of State, and was chosen indirectly by the Lovinian Federal Congress. During the FPDRL, the Prime Minister, who is selected by the President, served as the Head of Government.

Election

According to the Article 16, Section 4 of the Constitution of Lovinia, the Captain-General shall be elected by the people with a majority vote. His or her term shall be two years. Their term can be renewed twice.

Qualifications

As stated by Article 16, Section 7 of the Constitution of Lovinia, a person cannot be elected Captain-General unless;

a.) He has served a two-year term in the National Council;

b.) Is a born citizen or a citizen of the Captaincy of Lovinia at the time of the ratification of the Constitution;

c.) Can read and write;

d.) Is of sound mind and body; and

e.) Has lived in the Captaincy of Lovinia for at least a year.

Overseas citizens are not qualified to run for the position of Captain-General.

Election Proceedings

Citizens who intend to run for the office must register as a candidate with the Lovinian Electoral Commission by a specified date, pass the required documents, satisfy the qualifications, and be a member of a political party. After a week, the list of successful candidates will be made public. The elections will take place on December 1. They will vote using the First-Past-The-Post method for the rank of Captain-General. They will take the oath of office on January 1.

Oath

The Captain-General shall say the oath to confirm his appointment before noon of January 1.

I, (name), do solemnly swear that I will faithfully and conscientiously fulfill my duties as Captain-General of the Captaincy of Lovinia, preserve and defend its Constitution, execute its laws, do justice to every man, and consecrate myself to the service of the Nation. I will uphold the Constitution of the Captaincy of Lovinia and the fundamental rights of the Lovinian citizens and residents, that I will bear true faith and allegiance to Lovinia, and will discharge the duties and responsibilities of the office of Captain-General honestly and faithfully in accordance with the Constitution and laws of the Captaincy. So help me God.

Powers and Functions

The Captain-General has the following powers and duties;

a) to faithfully carry out and enforce the provisions of this Constitution as well as all applied national laws;

b) to receive all ambassadors and to carry out national defense and foreign affairs in accordance with the law;

c) to appoint the leaders of some barrios, poblacion, and purok if deemed necessary;

d) to appoint members of the National Council in cases of vacation given that the seat is vacant less than six months into the next election;

e) to decorate people with awards created by the legislation;

f) to appoint ambassadors, all members of the National Board of National Board of Peacemakers, and other officers as may be required by statute, with the National Council’s advice and consent. The Captain-General appoints ambassadors and officers to serve at his pleasure; and

g) to carry out any other duties as may be required by law.

The Captain-General is also responsible for reporting to the National Council on the status of the country and leading the Lovinian Peacekeeping Guards. A special session of the National Council may also be summoned by the presiding officer at the proposal of the Captain-General or at the formal request of two-thirds of the members.

In circumstances of impending natural or man-made disaster, a national government crisis, a public health emergency, such as a pandemic or epidemic, or immediate hazards of conflict, insurrection, uncontrolled violence, invasion, and disorder, the Captain-General may declare a state of emergency or martial rule. The National Council must approve this declaration. In times of martial law, he or she has the authority to suspend the writ of habeas corpus.

As head of both councils, the Captain-General is a part of the Lovinian Cabinet and the Lovinian Security Council.

When a Head Peace Officer is removed, the decision is reviewed by a special tribunal composed of one Barrio Peace Officer from each Barrio nominated by the Barrio leader. The special tribunal will be convened at the Captain-General's discretion.

Replacement to the Current Captain-General

In circumstances of treason, bribery, misuse or mismanagement of authority, or other acts of corruption in office, the Captain-General may be impeached. To impeach the President, the National Council must vote with a two-thirds majority. Before the impeachment is approved, there will be a hearing. The judgment of the Captain-General, who has been dismissed from office, must be reviewed by the National Board of Peacemakers.

The Captain-General may also be removed by circumstances of formal resignation, which he must submit to the National Council Speaker, sudden death, or worsening health condition.

Captain Pro-Tempore

According to Article 16, Section 8 of the Lovinian Constitution, a Captain Pro Tempore must be appointed in circumstances where the Captain-General is on a diplomatic mission or state visit in another country, or is on a health or wellness leave approved by the National Council.

The Speaker of the National Council

The Speaker of the National Council serves as the Captain-de General's de facto deputy. He or she is also second in the Captaincy Line of Succession.

Captain-Emeriti

The Captain-Emeriti (plural: Captain-Emeritus) are former Captains-General who served in the position. Except for those who are impeached while in office, they are also members of the Lovinian National Council.
