The constitution of the EXE/SDA California Republic is made in 2021 and We make a Union Called The North American Union and a defensive pact called the Pacific Atlantic Treaty Organization on May 5 of 2022 and On May 18 of 2022 we confirm the first 2 cases of COVID-19 and we have confirmed we will lockdown when we reach 500 confirmed cases. We have confirmed two more cases of COVID-19 on May 26 of 2022 leading to the EXE/SDA California Republic having 4 cases and we have reached a total of 400 confirmed cases on September 26 of 2022. In a speech that was made by Lucy the president of The EXE/SDA California Republic he said this. "We shall not accept the atrocities in Ukraine Putin is commiting and the aggressive actions of trying to reform the Soviet Union is unethical and he should be stopped at all costs to prevent a nuclear world war or a world war from happening."

The Constitution of The EXE/SDA California Republic is the fundamental law of the EXE/SDA California Republic. The constitution was started on 7 December 2022 after A decision to remake the constitution. It technically serves as the 2nd version of the EXE/SDA California Republic Constitution, as it was completely rewritten.

The document covers aspects about The EXE/SDA California Republic, including its law, National Symbols, rights of the citizens, free speech, The Rights, ect. Despite this, multiple parts of the constitution have been surpassed by newer legislation, notably multiple state symbols. The Constitution is entirely written in English and amendments will be added in the future.


The Whole Constitution:

Her Excellency, President Lucy Bennett on behalf of the people and pursuant to the goals laid out in this constitution, hereby establishes the EXE/SDA California Republic

 Amendment I

   Section I: Free Speech

  1. The EXE/SDA California Republic promises to give its  inhabitants and people the right for free, unhindered speech unless it comes across as abusive or impactive to those of a minority group or gender.
  2. The previous statement includes sexuality, background, different political ideologies or opinions, ect.
  3. Said individual is also allowed to vocally express this freedom of speech, so long as it is not intrusive or intended to cause harm. This can be done in any legal way, as long as it isn’t expressed via illegal forms (via explicit content, through violence, ect.)

Section II: Democracy

  1. The EXE/SDA California Republic is a Democratic nation, and all bills, articles or laws that are brought up must pass through a vote from the senate or even the general public before being published.
  2. The people of The EXE/SDA California Republic are also granted the freedom to democratically choose their leader or political party, without the intervention of the state.
  3. The EXE/SDA California Republic has political parties set up by the government for the general public to vote for during elections. These include:

Communist Party ESCA, Republican Party ESCA, DemSoc Party ESCA,AnPac Party ESCA, AnQueer Party ESCA, LGBTQ Party ESCA.

Any citizen of EXE/SDA California is allowed to apply for a seat in their party to be voted on for a seat in the senate by the general public.

  1. In order to become a leader of a political party, one must be an established citizen, received an EXE/SDA Californian grade education and have a clean criminal record.
  2. A person who has voted more than once, hasn't cast their vote in a manner that is clear or is earmarked to be unable to vote will have said vote disqualified and will be notified about implications towards future votes.
  3. A satirical or joke party cannot have a majority or hold over half the seats in Government.

Section III: State form

(1) The EXE/SDA California Republic is a sovereign, and democratic republic. All entities of The EXE/SDA California Republic and her States must yield to these principles.

(2) This Constitution is the supreme law of the land; it is directly binding on all EXE/SDA Californian authority regardless of the circumstances.

(3) The general rules of public international law constitute an integral, critical part of the national law and is also directly binding.

Amendment II:

Section IV: General Objectives of the State

  1. The EXE/SDA California Republic promotes Justice, the expression of opinions and Humans Rights as individual rights for all its people.
  2. The EXE/SDA California Republic and all who control it recognise the Rights expressed by the people under EXE/SDA Californian law.
  3. The EXE/SDA California Republic endeavors to promote:
  1. Education for those who require it.
  2. Access to clean water via the EXE/SDA California Republic’s Macronational hosts.
  3. The expression of opinions and free speech.
  4. The right to vote for their leaders.
  5. The right to safety for an individual or their associates.
  6. The preservation and conservation of historical artifacts or locations.
  7. Conservation of environmental locations
  8. The conservation and development of human culture; EXE/SDA Californian or otherwise.

 

Section V: Security and Peace

  1. The EXE/SDA California Republic promotes peace and balance between other Sovereign states.
  2. The EXE/SDA California Republic maintains a military force for the following reasons:
  1. Protection of Sovereignty.
  2. Defense and wellbeing of the People against acts of heinous crimes and Terrorism.
  3. Protection of property owned or controlled by the EXE/SDA California Republic.

 (3) The EXE/SDA California Republic promises not to use its    

   military in vain or to seize land controlled by

   another sovereign entity or being.

 (4) The EXE/SDA California Republic formally takes a vow of    

     Peace and promises not to initiate conflicts

     With any Recognised, Sovereign states unless

     The Sovereignty of the Republic is violated.

 (5) It is decreed that any such Military operations

     are done secretly and any details remain

     Confidential to the public and wider

     Micronational Community for up to 6 years after

     the event took place.

Section VII: Voting and Elections

  1. An individual can only cast one vote towards the party or individual whom they desire.
  2. In order to count as a vote, a clear cross must be marked on the ballot paper within the designated box in black pen.
  3. Votes will be disqualified if the ballot is not clearly or correctly marked.
  4. Individuals must be over the age of 9 years in order to cast their vote.
  5. Votes are to be done in secret, with no influence being enforced by their employer or other figure.
  6. Voting is not mandatory.
  7. Elections are always free and fair following the principle of “one vote, one eligible voter” rule.
  8. No citizen can be sanctioned by revealing:
  1. Whom they voted for.
  2. Whether they chose to vote or not.

Section VIII: National powers

  1. State powers belong solely to the President and can be exercised for the following reasons:
  1. Foreign affairs;
  2. National Defence;
  3. Economic regulations;
  4. Infrastructure and Transportation;
  5. Taxation of the People;
  6. Exercise in State Law;
  7. Education and Health;
  8. And any other matters for whom concern the attention of the people and senate.

 (2) The EXE/SDA California Republic may give up sovereign powers to international or supranational bodies, including systems of mutual collective security, as long as it retains an adequate representation in those bodies and those bodies guarantee sufficient legal protection for the People.

Section IX: National Government

  1. The EXE/SDA California Republic is an Democratic Republic, which means that a Government is necessary to oversee the state.
  2. A Government would oversee all issues of the state, such as Diplomacy and infrastructure via the passing of articles.
  3. A National Government has no executive powers, for articles must be approved by the senate in order to be legally binded.

Section X: Constitution

  1. The Constitution is recognised by the state and its people as a legally binding document for which provides the base for National law. No individual in the EXE/SDA California Republic is allowed to override this document.
  2. The Constitution is also recognised by the state and its people as a De Facto declaration of independence under Macronational law.
  3. Amendments can and will be added to The Constitution on behalf of the people by the senate and president and recognised as De Facto under National law unless it is believed to be unlawful or unconstitutional.

Section XI: Budget

  1. The budget is drawn up by the senate 6 times per year unless a Treasurer has been assigned.
  2. The budget must not be higher than the equivalent of 50% of the state GDP to ensure that the GDP isn’t immediately spent.
  3. If the budget is being organized by a Treasurer, the senate must be consulted to ensure that the correct budget is assigned to each department as part of their individual aspirations.
  4. Not all of the assigned budget has to be spent; anything left is redirected towards the next budget.

Section XII: Relations and Treaties

  1. Diplomacy involving Treaties is organized solely by the president.
  2. The President can pass this duty to a Foreign Minister as part of a Government or an assigned individual if required.
  3. Treaties with other Sovereign states are authorized and signed by the President, or the Vice President on behalf of the President in their absence.
  4. All relations and treaties remain binding until the Sovereign state goes inactive or is dissolved.
  5. The President can redact a Treaty at any time if felt necessary

Section XIII: Rights

Every Single Person Has All The Rights that the American Government has and Transgenders can legally change their name and gender.

Section XIV: State Symbols

  1. The EXE/SDA California Republic has the National Colors, the EXE/SDA California Republic Flag, Seal, and Coat of Arms as well as the National Anthem:

  3. The EXE/SDA California Republic’s flag is green, white, and red with a red bear, two red stars, and thirteen stripes
  4. The Seal of the EXE/SDA California Republic is [xxx].

  9. The Nation shall be known as the “EXE/SDA California Republic”, for formal purposes
  10. The Nation shall also be known as “EXE/SDA California” for informal purposes.

Section XV: Right To Bear Arms

A well regulated Militia, being necessary to the security of a free State, the right of the people to keep and bear Arms, shall not be infringed.

Amendment IV:

Section XX: Laws That Can and Cannot Change

The Current and future leaders of the nation can change the anti-discrimination laws and any protective laws.

Section XXI: Judgemental laws

No one is allowed to judge, murder, torture, bully, and say any negative statements about the clothes that someone is wearing as it is their own body and their own choice of clothing.

Section XXII: Laws on Murder and Self-Protection

Whoever is guilty of murder in the first degree shall be punished by death or by imprisonment for life; Whoever is guilty of murder in the second degree, shall be imprisoned for any term of years or for life. Unless it is in the case of self-protection and preservation then you have to prove that it was self-protection and not any individual killing another person that was not posing a threat to your safety.
