The President of Wescoyla is the head of state in the Islamic Republic of Wescoyla.

History

President is the oldest office in Wescoyla. It was established on 1 October 2022.

Election

The president is elected by the Parliament of Wescoyla. The two major parties in the National Assembly each nominate two candidates. Then the first round of voting occurs within the national assembly. The two candidates with the most votes are then moved onto the second round. In the second round the two remaining candidates are voted on by the senate using the direct election system. The candidate who achieves the highest amount of votes in both rounds is elected president.

Eligibility

The principal qualifications to become president are well defined to ensure all candidates would act in national interests. A president must be:

  • A Citizen of Wescoyla
  • A Muslim
  • Qualified to be a Member of the National Assembly

Role

The president of Wescoyla is formally vested with great power extending to all three branches of government. In practice, the conventions that bound the head of state and his representatives mean that executive power will typically be exercised by the prime minister and cabinet.

The president "shall act in accordance with the advice of the Cabinet or a Minister acting under the general authority of the Cabinet" except in certain circumstances, usually described as the reserve powers.

Executive Powers

The president is the nominal source of executive power. The president is almost always bound by convention to exercise this power on the advice of the prime minister and cabinet as well as the council of state.

The president appoints as prime minister the individual most likely to maintain the support of the National Assembly, typically the leader or senior most member of the party with the most seats within the house. The president must additionally appoint to Cabinet, on the advice of the prime minister.

Legislative Powers

The president, along with the Senate and the National Assembly, is one of the three components of parliament. Since the president is almost always required to act on the advice of the cabinet, the president's role in the legislative process is limited to assenting to bills and signing them into law. However, the president has the absolute power to withhold assent to Bills passed by Parliament (i.e. to veto without parliamentary override).

Furthermore, a form of pocket veto exists - there is no defined maximum time for presidential action on a Bill passed by Parliament, thus the president can hypothetically postpone the signature of a Bill indefinitely, effectively vetoing it.

The president additionally summons, prorogues, and dissolves parliament.

Judicial Powers

The president has the right to appoint judges with the approval of the senate, and pardon offenders. As well as this, the president typically appoints the Grand Mufti.

Oath of Office

The president is required to make and subscribe in the presence of the chief justice, an oath or affirmation as follows:

"I, (The name of the President-elect), do solemnly swear that I am a Muslim and believe in the Unity, and Oneness of Almighty Allah, the Books of Allah, the Holy Qura'an being the last of them, the Prophethood of Muhammad (peace be upon him) as the last of the Prophets and that there can be no Prophet after him, the Day of Judgment, and all the requirements and teachings of the Holy Quran and Sunnah:

That I will bear true faith and allegiance to Wescoyla:

That, as President of Wescoyla, I will discharge my duties, and perform my functions, honestly, to the best of my ability, faithfully in accordance with the Constitution of the Islamic Republic of Wescoyla and the law, and always in the interest of the sovereignty, integrity, solidarity, well- being and prosperity of Wescoyla:

That I will not allow my personal interest to influence my official conduct or my official decisions:

That I will preserve, protect and defend the Constitution of the Islamic Republic of Wescoyla:

That, in all circumstances, I will do right to all manner of people, according to law, without fear or favour, affection or ill- will:

And that I will not directly or indirectly communicate or reveal to any person any matter which shall be brought under my consideration or shall become known to me as President of Wescoyla, except as may be required for the due discharge of my duties as President.
