The State Owned Enterprises Act 2022 is an Act of Assembly which creates State Owned Enterprises in the Arstotzkan Union.

The Act introduces and creates the Department of the State, which is a conglomeration of the Ministry of Tourism, Ministry of Finance, Ministry of Horticulture and Department of Agriculture.

The SOE Act 2022 is also the first to use and create the newest legislation version, 2022.7. Which updates the previous version in modernizing its Preface and adding in an interpretation section.

The SOE Act was formally passed on 10 September 2022 making it one of the longest times between bill beginning and its passing in Arstotzkan History

History

The Act was originally created as the State Owned Enterprises Bill 2022 until it became an Act through the Federal Assembly and passed its first reading in the Executive Committee.

Contents

Section 1: Update to State Entities rather than State Organisations

Article 1: The following organisations and/or businesses shall be considered by this act as State Owned Enterprises:

Article 2: State Owned Enterprises shall also be known as State Owned Entities or State Entities

Article 3: Organisations formerly considered State Sponsored Organisations shall now be State Owned Enterprises.

Section 2: Establishment of the Department of the State

Article 4: The Arstotzkan Federal Government shall set up the Department of the State, pursuant to the assent of the provisions of this act.

Article 5: The Department of the State shall henceforth hold control over all areas of control of business and finances of the Arstotzkan Union.

Article 6: Pursuant to the provisions of the rules regarding the seated members of the Executive Committee of the Office of the Presidency of the Arstotzkan Union, a chairman for the Department of the State must be appointed by Comrade Right Honourable First President Kmdt. Ethan Brinkman, on the advice of the:

  • Minister of Finance;
  • Chairman of ArstotzkanComm;
  • Chairman of the Arstotzkan Independence Movement
  • Arstotzkan Press Director

Article 7: The Ministry of Finance, Ministry of Tourism, Ministry of Horticulture and Department of Agriculture shall all become part of the Department of the State.

Section 3: Activities of State Owned Enterprises

Article 8: On 1 June of every year all State Owned Enterprises shall submit, in writing, to the Chairman of the Department of the State, a list of all activities of the previous year and any possible future activities up until the next year.

Article 9: The Chairman of the Department of the State must deliver these in writing to a full seated session of the Executive Committee of the Office of the Presidency of the Arstotzkan Union.

Article 10: Any new business registered in the Arstotzkan Union, must submit, in writing:

  • The name of the Business;
  • and the purpose and activities of the business;
  • and any other details relating to the business in question.

This must be delivered to the Department of the State and the new business will become a State Owned Enterprise.
