The Supreme Court of Arlandica (Cebuano: Korte Suprema sa Arlandika) is the sole and highest court of the Kingdom of Arlandica. It was inaugurated on December 9, 2023, after the ratification of Act of Parliament No. 8, proposed by Benz Gian Arellano and signed by King Jerold I. However, the Arlandican judicial system, in general, lacked autonomy from the executive power.

History

The Judiciary of Arlandica had been dependent on the executive branch, headed by the monarch, since the country's establishment. Between 2021 and 2022, there were attempts to create a judicial court; however, it was not pursued by the government.

According to the 2022 Arlandican Constitution, it permits the Parliament to establish a supreme court if necessary. On December 9, 2023, the Supreme Court was finally inaugurated after the ratification of Act of Parliament No. 8 proposed by Benz Gian Arellano and approved by King Jerold I. However, Jerold I did not appoint an associate justice yet.

Function

The Supreme Court is composed of the monarch, who serves as the high judge, and an associate justice. The Supreme Court is primarily responsible for interpreting laws and resolving legal disputes. The Court has original jurisdiction over constitutional issues, cases involving national interests, and conflicts between entities. In addition to being the highest court, it is also a trial court. The Supreme Court decides the punishments for lawbreakers and criminals, regulating conflicts and issues involving its subjects.

The Supreme Court safeguards constitutional rights and liberties, promoting justice and the rule of law. The Court may issue legal opinions, advisories, and judgements to guide legal interpretation and application.

Role of the monarch

The monarch possesses full judicial powers, acting as the highest judge in the land. The monarch has the authority to preside over and render judgments in cases of significant national importance and constitutional disputes. The monarch decides the punishments for lawbreakers and criminals, regulating conflicts and issues involving its subjects.

Unconstitutional Practices by the Monarch

In accordance with Section 58, Article 5 of the constitution, in cases where the Monarch's actions are deemed unconstitutional, the president of the Parliament has the authority to review and evaluate such actions, providing a necessary check on the exercise of judicial powers. In such cases, if there is an Associate Justice, he/she may collaborate with the president of the Parliament in investigations. The Monarch shall abdicate his throne and replace it with his/her heir apparent if found guilty, or the decision is up to the president of the Parliament and the Associate Justice.

Associate Justice

The Associate Justice (Cebuano: Kaubang Manghuhukom) assists and collaborates with the monarch in judicial affairs. In cases where the monarch is absent, the Associate Justice has the power to preside and exercise rulings.

Appointment

The monarch retains the authority to appoint an Associate Justice to the Supreme Court. The monarch may dismiss an Associate Justice for reasons of misconduct, incapacity, or any substantial violation of ethical standards.

To be eligible for appointment as an Associate Justice:

  • The individual must be a citizen of Arlandica.
  • The individual must be aged 16 and above.
  • The individual must possess knowledge of the constitution and laws of Arlandica, acquired through one month of study.

Facility

The Supreme Court currently has a room inside the Government Center building in Santo Niño City, Mainland Arlandica, the capital of the country.
